Privacy Policy
This Privacy Policy explains how Solene Medical, P.A., a New Jersey professional corporation doing business as Solène Medical Aesthetics ("Solène," "we," "us," or "our"), collects, uses, and shares information through solenemedical.com and related pages (the "Website"). It applies to information collected through the Website and the third-party platforms we use to operate it. This Policy addresses information collected through the Website and related online services. Information governed by HIPAA and our Notice of Privacy Practices is addressed separately as described in Section 2 below.
1. Scope of This Policy
This Policy covers information collected through the Website — for example, when you browse the Website, submit a contact form, request or book an appointment, place a payment method on file, enroll in a membership, or sign up to receive communications. Please read this Policy together with our Website Terms & Conditions.
2. Relationship to HIPAA and Our Notice of Privacy Practices
As a medical practice, our handling of protected health information (PHI) is governed by the Health Insurance Portability and Accountability Act (HIPAA) and our Notice of Privacy Practices. Depending on the context, information you provide through the Website or through Boulevard — for example, when you request or book an appointment, complete forms, or communicate with us about care — may constitute PHI. Where HIPAA and our Notice of Privacy Practices apply, they govern that information and control to the extent of any conflict with this Policy.
This Policy generally addresses information collected through the Website that is not otherwise governed by HIPAA or our Notice of Privacy Practices. To help keep sensitive information secure, please do not submit detailed medical history or health information through the Website's general contact or request forms; medical and consent forms are provided to you separately and completed through our booking and forms platform.
3. Information We Collect
We collect the following categories of information through the Website:
Information you provide — your name, email address, telephone/mobile number, and similar contact details you submit through the contact page or when you request or book an appointment; scheduling preferences and the services you inquire about; membership enrollment information; and any message or information you choose to send us.
Payment information — when you place a payment method on file for an appointment holding fee or a membership, payment card and billing information is collected and processed through our third-party booking and payment platform and its payment processor. Payment card information is processed through third-party payment services, and Solène does not directly process full payment card numbers through the Website.
Information collected automatically — our Website and service providers may automatically collect certain technical information, including IP address, browser type, device information, pages viewed, and information collected through cookies or similar technologies. The specific cookies and tracking technologies used may vary depending on the Website's configuration and the services enabled.
4. How We Use Information
We use the information we collect to respond to your inquiries; to schedule, confirm, and manage appointments; to process holding fees, memberships, and related transactions; to provide patient forms and communicate with you about your requests and account; to operate, maintain, secure, and improve the Website; to send you marketing communications where permitted (see Section 7); and to comply with legal obligations and enforce our Terms.
5. How We Share Information
We do not sell your personal information. We share information only as follows:
Service providers — with the third-party platforms that operate the Website's features on our behalf, including our booking, patient-forms, payment, and communications platform (Boulevard), our website host (Squarespace), and any payment processor. Where applicable, service providers that handle PHI on our behalf are subject to HIPAA and applicable contractual requirements.
Third-party retailers — if you follow a link from the Website to a third-party retailer (for example, to purchase skincare products), any information you provide to that retailer is governed by the retailer's own privacy policy, not this one.
Legal and safety — when we believe disclosure is required by law or legal process, or is necessary to protect the rights, safety, or property of Solène, our patients, or others.
Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to applicable law.
6. Third-Party Platforms and Links
We use third-party service providers, including Boulevard for booking, forms, payments, and communications, and Squarespace for website hosting. Information processed by Boulevard or Squarespace on our behalf is handled in accordance with our arrangements with those providers and applicable law, including HIPAA where applicable.
This is different from unrelated third parties: the Website may also link to independent third-party websites and retailers (for example, to purchase skincare products) that do not act on our behalf. Information you provide directly to an unrelated third-party website or retailer is governed by that party's own privacy policy, which we encourage you to review, and we do not control those parties' privacy practices.
7. Marketing Communications; Your Choices
With your consent where required by law, we may send you marketing emails and text messages about our services, promotions, and events, including through Boulevard.
Text messages — we send marketing text messages only to individuals who have given prior express consent to receive them at the number provided. Consent to receive marketing text messages is not a condition of purchasing any service or product. Message and data rates may apply, and message frequency varies. You may withdraw consent at any time by replying STOP to any marketing text (or as otherwise described in the message), after which you will not receive further marketing texts; we may send a single message confirming your opt-out.
SMS/Text Messaging: Mobile phone numbers and SMS opt-in consent collected for text messaging will not be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with service providers who help us deliver messages (such as our messaging and scheduling platforms), solely to provide those services.
Emails — our marketing emails identify themselves as promotional, include our postal address, and provide an unsubscribe link. You may opt out of marketing emails at any time using that link. We will honor opt-out requests within the time required by law.
Transactional messages — even if you opt out of marketing, we may still send you non-marketing messages about your requests, appointments, forms, and account.
8. Cookies and Tracking Technologies
The Website and our service providers may use cookies and similar technologies to operate the Website, remember preferences, understand Website usage, and support functionality such as appointment booking. The types of cookies and technologies used may vary depending on the Website's configuration and the services enabled. You can manage certain cookie preferences through your browser settings and any cookie-management tools made available on the Website.
9. Data Security
We, and the third-party platforms we use, maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive health information through unsecured channels such as the Website's general contact form, email, or text.
10. Data Retention
We retain information collected through the Website for as long as needed to fulfill the purposes described in this Policy, to comply with our legal and recordkeeping obligations (including those applicable to healthcare providers and advertising records), to resolve disputes, and to enforce our agreements.
11. Your Privacy Rights
Depending on where you reside and the laws that apply, you may have certain rights regarding your personal information, including rights to request access, correction, deletion, or other actions concerning your information. To exercise any available rights or ask questions about your information, please contact us using the information in Section 13. We will respond to requests as required by applicable law. Rights relating to protected health information are governed separately by HIPAA and our Notice of Privacy Practices.
12. Children's Privacy
The Website is intended for adults and is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Website. Any services provided to minors are subject to applicable consent and authorization requirements.
13. Changes to This Policy; Contact Us
We may update this Policy from time to time. Changes are effective when the revised Policy is posted on the Website, and the "Last Updated" date above reflects the most recent revision.
